Please read the following Terms of Service carefully. By accepting our quote and using our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions of Service.

**TERMS AND CONDITIONS OF SERVICE**

**1. INTRODUCTION**

Welcome to L&S Poopin Scoopin, LLC ("L&S Poopin Scoopin," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our services and establish the legal agreement between L&S Poopin Scoopin, LLC and you the customer ("user," "you," or "your"). By using our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, please refrain from using our services.


**2. SERVICES**

L&S Poopin Scoopin offers residential and commercial pet waste cleaning services. These services include weekly, twice weekly and one time cleanings. These services include the cleaning and disposal of pet waste for each visit unless otherwise noted in your quote. We will thoroughly scoop, securely bag, and dispose of the waste off-site. If, during our visit, we come across any feces that appear unusual or concerning, we will promptly take photos and notify you via text, allowing you to take appropriate action. However, it's important to note that we are not trained veterinarians, and as such, we are not responsible for the health of your dogs.


**3. PRICING**

Our weekly and twice weekly maintenance pricing is based on service for one dog and a yard size of 1/8 acre or less. Additional charges will apply for larger lots and additional dogs.

Our one-time cleanup service starts at $75.00 (per service) This is for one dog and yards 1/8 acre or less. Additional charges will apply for larger lots, additional dogs and the amount of accumulated waste to be cleaned.

The initial visit charge is determined by factors such as the number of dogs, yard size, and the pet waste accumulation in your yard. In cases where it is deemed necessary, an additional fee of $50 (or more) may be applied; however, we will always consult with you and this amount will be included in your quote for service. After the initial visit and any applicable fee, the regular weekly rate will be charged for your ongoing services.

The customer is required to promptly inform L&S Poopin Scoopin of any changes in the number of dogs under our service. Failure to report additional pets may result in termination and the full repayment of associated fees, which are currently set at an additional $5 per dog. In cases where unreported dogs are detected, we retain the right to adjust your monthly statements without prior or subsequent notice as deemed necessary.

The Customer agrees to pay the fees for services as outlined in the quote for services.

We reserve the right to modify pricing with a notification period of 30 days in advance.


**4. BILLING, PAYMENTS, AND REFUNDS**

L&S Poopin Scoopin offers weekly and bi-weekly billing for our customers receiving on-going weekly services. You agree to pay the agreed-upon amount as per our pricing policy and quote provided to you. Payments are due and payable according to the terms stated on your invoice. Failure to make timely payments may result in the suspension or termination of Services.

Invoices are sent to the email on file and are due upon receipt. Invoices become past due after 7 days and a late payment fee of $10 will be added to each bill that is late. If payment has not been received by the time of your next visit, your service will be skipped until your invoice has been paid.

L&S Poopin Scoopin requires all one time cleanings to pay a $50 deposit for the service prior to scheduling. Invoices for one time cleans will be billed after the service has been completed and payment is due within 24 hours.

If payment becomes more that 30 days late, we will turn your account over to collections.

Services of L&S Poopin Scoopin are non-refundable, however, service may be canceled at any time.


**5. APPOINTMENTS, CANCELLATIONS RESCHEDULING**

If you need to cancel or reschedule your appointment, please notify us via text at least 24 hours in advance. Failure to do so may result in a $10 cancellation fee.

We reserve the right to change service days as needed. In certain circumstances, such as extreme inclement weather or unforeseen events, we may need to reschedule or cancel appointments. In such cases, we will make every effort to communicate with you and accommodate your needs.

At present, we are unable to offer specific appointment times due to the various factors that influence our daily routes. However, we assure you that your service will be carried out on your designated service day. While we may attempt to provide estimated time frames for service visits, please be aware that these times may fluctuate as we optimize our routes using routing software to ensure efficiency and minimize drive times, which may involve adjusting our client schedules.  

During periods when your dog(s) won't be utilizing the yard, such as vacations or illness, and you wish to avoid incurring charges for an unnecessary visit, kindly inform us at least 48 hours in advance that you would like to skip your weekly scoop. Failure to provide this notification will result in the full service rate being billed.

If you wish to cancel your service with L&S Poopin Scoopin, you may do so at any time via email, text or phone call. Outstanding fees must be settled upon termination.


**6. INCLEMENT WEATHER**

L&S Poopin Scoopin will work through the rain and cold so long as it is safe to do so. The Customer understands that we will not perform services during lighting or thunderstorms, high winds, extreme (high or low) temperatures, flooding, or snow/ice accumulations. Therefore in these cases, we will skip service for that day and see you on your next regularly scheduled service day. We do not offer refunds for missed days due to inclement weather as we still have to pick up all of the poop that would have been scooped on the skipped day.

If you need the area cleaned before your next scheduled service day, please call us and we will do our best to try and accommodate your request, however, we cannot guarantee it. Additionally, we do not want to tear up your yard in any way. If it is extremely frozen or muddy, we may skip your yard and wait until the next scheduled visit when things have dried out.


**7. HOLIDAYS**

L&S Poopin Scoopin does not provide services on the following holidays: Memorial Day, Independence Day, Easter, Labor Day, Thanksgiving Day, Christmas Eve, Christmas Day and New Year’s Day. If your service day falls on one of these days, we will skip service that week and pick up double the waste the following week. There are no refunds for a missed pick up due to Holidays as we still have to do the work and pick up all of the poop from the Holiday the following week.

Additionally, we reserve the right to shut down operations fully between Christmas Eve and New Years Day. You will be billed at your normal rate unless you scoop and maintain your yard fully during this time.


**8. PROPERTY ACCESS, SAFETY AND CUSTOMER RESPONSIBILITIES**

L&S Poopin Scoopin  provides notice of all visits via text. To make your experience more convenient, we will send you a text message when we are on our way to your location with an estimated time of arrival and another text when we have completed your service and have exited your yard.

While we love dogs, we kindly request that your dogs be kept inside or in a secure area during our visits to ensure their safety and allow us to perform our tasks efficiently. You are responsible for ensuring a safe environment for us to perform our duties. This includes ensuring that your pets are properly restrained or confined during the appointment. You agree to indemnify and hold L&S Poopin Scoopin harmless from any claims arising due to safety hazards or injuries caused by your pets or your property.

It is expected that the day of your appointment the yard will be accessible for cleaning.
The Customer understands that if we can’t access the area needing to be cleaned due to locked/blocked/frozen gates or dogs in the yard; the scoop will be skipped and regular charges will still apply. We suggest adding gate combinations or lock keys to your file to avoid locked gates. If we are unable to access your yard and you request we come back, a $5 driving fee will be added to the your bill.

We will always do our best to clean your yard to the best of our ability. We do not move lawn objects to scoop but will scoop around them. We understand that maintaining your yard is a lot of work and it may not always be in the best shape. The Customer understands that it can be very difficult to find dog poop in tall grass or in a yard full of leaves or other debris. If your grass is tall when we come, there may be some dog waste that is missed. We will be back on our next scheduled visit and will get anything that was missed if yard maintenance has been completed. If you find an excessive amount that we missed, please let us know as soon as possible by sending a text to 360-913-6208.

**9. LIABILITY**

L&S Poopin Scoopin will always perform services with the utmost care and professionalism. While we take great care in providing our Services, the Customer  understands that there may be inherent risks associated with pet waste removal. You agree to assume all risks and further acknowledge that L&S Poopin Scoopin, LLC, its employees, or affiliates shall not be held liable for any damages, injuries, or losses arising from the use of our Services. L&S Poopin Scoopin is not liable for any damages or injury caused by pets or for any escaped dogs due to defective gates, fences and/or latches. We will notify you immediately if we see that your gate is defective or in need of repair.

**10. Marketing Materials**

By engaging our services, all customers grant L&S Poopin Scoopin permission to utilize images and photographs showcasing the services provided at the client's property or residence. These images may be featured on our website, social media platforms, and in any marketing materials, whether in print or digital form. Rest assured, we will never disclose personal or identifying information in any of the photos used. If you wish to opt out and us not  post pictures of your yard or pet(s), simply let us know by e-mail: lspoopinscoopin@gmail.com


**11. REVISIONS**

L&S Poopin Scoopin  provides the above Services to you subject to the Terms, which may be amended from time to time without notice to you. Amendments will be effective upon our posting of such updated Terms to our website. We recommend you visit the Sites to review any changes in our practices. Your continued use of our Services shall constitute acceptance to any changes to the Terms. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

**12. Intellectual Property**

All content, including but not limited to logos, trademarks, text, graphics, images, and software, used or displayed on our website or provided as part of our Services, are the exclusive property of L&S Poopin Scoopin LLC. You may not use, reproduce, distribute, or modify any of our intellectual property without obtaining prior written consent from us.


**13. Privacy**

We respect your privacy and handle your personal information in accordance with our Privacy Policy. By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy posted on our website.


**14. Governing Law and Jurisdiction**

These Terms shall be governed by and construed in accordance with the laws of the State of Washington in which L&S Poopin Scoopin, LLC is registered. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of that state.
